This Privacy Policy is designed to explain in detail how Learning A-Z (“Learning A-Z,” “we,” “us,” or “our”) gathers, utilizes, and reveals information when you interact with our websites, online services, and mobile applications that are linked to this Privacy Policy (each referred to as a “Service” and collectively as “Services”). By using any of our Services, you are giving your consent to the collection, use, and disclosure of your information as outlined in this Privacy Policy. Furthermore, when you permit others to access and use any Service through your account, you are confirming that you have the authority to consent on their behalf to our data practices as described below. Learning A-Z markets and sells its educational products to adults, who then purchase subscriptions for use by children under their direction and supervision. We are deeply committed to the privacy of all our users. Recognizing the particular need to protect the personal information of children under 13 as mandated by the U.S. Children’s Online Privacy Protection Act of 1998 (“COPPA”), we have a dedicated Children’s Privacy Policy that details our practices concerning children’s data.

This policy is effective from the date shown above and may be updated periodically to reflect changes in our practices, legal requirements, or service enhancements. The most current version of this Privacy Policy is always available for your review. In the event of material changes, we will provide a clear explanation of these changes and notify the account owner/administrator via the email address provided during enrollment.

A Special Note to Children: If you are under 13, please seek permission from your parent or legal guardian before using our Services. Purchasing or subscribing to any Service requires you to be 18 or older. We do not directly market to children under 18 and always seek parental or legal guardian consent if we identify a minor attempting to purchase or subscribe.

A Special Note to Parents: We urge you to help protect your children’s privacy by instructing them never to share personal information online without your explicit permission.

1. Information Collection and Usage by Learning A-Z

Throughout this Privacy Policy, “Personal Information” refers to data that can directly or indirectly identify or contact you, such as your full name, physical address, email address, and phone number. It also includes anonymous data linked to identifiable information. Information that is anonymized or aggregated and can no longer identify you is not considered Personal Information.

“Non-Personal Information” refers to data that cannot identify you and is not linked to your Personal Information. This includes passively collected usage data from our Services, as long as it is not linked to your Personal Information.

1.a Account Creation for Teachers and Parents

Teachers, parents, and adult visitors over 18 must create accounts to purchase or access free trials of Learning A-Z Services. During the online purchase process, we collect:

  • First and last name
  • Street address
  • Email address
  • Phone number
  • School and school district details
  • Username, password, security question and answer
  • Optional: fax number, occupation, class grade level

For credit card payments, we collect and transmit (but do not store) credit card number, card type, expiration date, and security code. For payments via purchase order, check, or money order, we collect mailed payment information. For free trial accounts, we collect full name, street address, email address, occupation, school and district affiliation, and username. Post-account creation, we also record your preference regarding receiving eNews, updates, and offers.

This Personal Information is used solely for:

  • Obtaining verifiable parental consent when necessary
  • Processing transactions
  • Sending order confirmations and legal notifications
  • Providing Service access and ensuring copyright compliance
  • Delivering customer, technical, and sales support

1.b Teacher Login Credentials

Learning A-Z Services such as Kids A-Z, Raz-Plus, Raz-Kids, Headsprout, Science A-Z, ReadyTest A-Z, Writing A-Z, and Vocabulary A-Z offer online learning tools through teacher, student, and parent portals. For teacher access, we collect the username and password created during purchase or assigned by your school/district upon each login. Email addresses submitted for password resets are also collected.

This information is used only to:

  • Verify identity and authenticate logins
  • Facilitate content access
  • Monitor subscription compliance
  • Provide customer, technical, and sales support if you purchased the subscription directly.

Login credentials may be displayed to school coordinators to facilitate content access if the subscription was purchased on your behalf.

1.c Parent Login Credentials

Parents of children using Kids A-Z, Raz-Plus, Raz-Kids, Headsprout, Science A-Z, ReadyTest A-Z, Writing A-Z, or Vocabulary A-Z through a school or teacher account can request parent portal access. We collect your email address to enable account creation and collect login credentials upon each login. Email addresses used for password resets are also collected.

This Personal Information is solely used for:

  • Verifying identity
  • Authenticating logins
  • Facilitating access to the parent portal

1.d Student Login Credentials Created by Teachers and Parents

For online learning tools within Kids A-Z, Raz-Plus, Raz-Kids, Headsprout, Science A-Z, ReadyTest A-Z, Writing A-Z, and Vocabulary A-Z, teachers must create classroom rosters and student login credentials. We collect and store these student login credentials, using them only to provide service access to you and your students.

1.e Account Activity by Teachers and Parents

Upon initial login to the teacher portal for online learning Services, we collect your first and last name, class name, grade level, and school name. Classroom reports, accessible to teachers and parents, track student progress, including activities completed, login frequency, stars earned, rankings, and accuracy levels. Teachers can review student activity, assign tasks, access voice recordings, and send voice/text messages to students. Parents can review their child’s activity and send text messages but cannot assign tasks.

We use this data to:

  • Verify identity and authenticate logins
  • Facilitate access to paid content
  • Monitor subscription compliance

You control the student information you provide, which should be limited to data relevant to improving student performance. We instruct you not to enter irrelevant student information. You are responsible for the accuracy and updating of student data. “Class chart” names need not be a student’s actual name. Contact us for assistance with corrections. Student information is used to provide services to educational institutions and will be deleted upon their request. Unauthorized use of student data is prohibited.

While logged into teacher or parent portals, we automatically collect Non-Personal Information about Service usage for internal operations, such as feature usage, downloads, and session frequency. This Non-Personal Information is not linked to your Personal Information.

1.f Correspondence with Learning A-Z

When you contact us via website messages, chat, email, or newsletter sign-ups, we collect both Personal and Non-Personal Information to provide support and services related to your requests.

1.g Location Information

On our teacher-facing ReadyTest A-Z website, we collect geographic location data to provide Texas-specific content to educators in Texas. Location data is collected only if you enable location services on your device or expressly grant permission when prompted on the website.

1.h Automated Information

We automatically receive and record technical information, including IP addresses, from your browser to enhance Service functionality. IP addresses are combined with browser-submitted data to create access logs, which we analyze to understand usage trends, such as popular pages, browser types, and geographic access patterns. Access logs do not contain information uniquely associated with any individual IP address or Personal Information.

1.i Cookies

We use “cookies” on our commercial Site, www.learninga-z.com, to collect data on visitor behavior, such as pages visited, links used, and time spent on pages. Cookies also support site features and personalize user experience by remembering preferences and previously entered information. While cookie-collected data is not personally identifiable by itself, it may be linked to Personal Information you provide. You can manage cookie settings in your browser, but disabling cookies may limit site functionality.

2. Sharing of Collected Information

Learning A-Z does not share collected information with third parties for their marketing purposes and only shares data as described below.

2.a Personal Information

2.a.1 Service Providers

We may share Personal Information with third-party service providers as necessary for them to perform services on our behalf, such as email services, payment processing, and operational support.

2.a.2 Corporate Affiliates and Business Transactions

Personal Information may be shared with our parent company and Learning A-Z affiliates. In the event of a business transition (merger, acquisition, etc.), your Personal Information may be transferred as part of company assets. By using our Services, you consent to such transfers and acknowledge that acquirers may continue to use your Personal Information as described in this Privacy Policy.

2.a.3 Legal Compliance and Security

We reserve the right to disclose Personal Information when legally required, such as in response to court orders, subpoenas, or legal processes. We may also disclose information to law enforcement or when necessary to investigate illegal activities, fraud, potential threats, violations of our Terms of Service, or to enforce compliance with our policies and applicable laws.

2.a.4 Consent

We may share your Personal Information with third parties if you provide consent to such sharing.

2.b Authorized Educational Institutions and Third Parties They Authorize

We may disclose student information to authorized personnel at the student’s educational institution. When we receive assessment or other information, including student Personal Information, from a third-party source at the request of an educational institution, we treat it with the same confidentiality and security as if provided directly by the institution. Additional agreements may be needed to authorize such data transmission.

Educational institutions may request that we provide student information to third parties of their choice. We will only do so with written authorization from the institution, acknowledging that we act as their agent and that we lose control over the data once it is transferred to the third party. By requesting such disclosure, the educational institution releases us from responsibility for the subsequent use or disposition of the information.

Upon written request, we will destroy student information for institutions no longer using our Services and provide written confirmation of data destruction. If an institution is inactive for ten years, we will notify them that student data will be destroyed unless they request its retention.

2.c Non-Personal Information

This Privacy Policy does not restrict our use of Non-Personal Information, and we reserve the right to use and disclose it to third parties at our discretion. However, if we wish to release Non-Personal Information that identifies a school or educational institution by name, we will seek a separate agreement with the school or district purchaser for authorization.

3. Districts and School Systems

Under our contracts with schools, Learning A-Z acts as a “School Official” as defined by FERPA, which means we:

  • Perform services that the school would otherwise perform with its own employees.
  • Meet the criteria for a School Official with legitimate educational interest as per the school’s FERPA notification.
  • Are under the direct control of the school or district regarding the use and maintenance of education records.
  • Use education records only for authorized purposes and do not re-disclose them without specific authorization from the school or district and as permitted by FERPA.

4. Account Holder Communication Preferences

You have control over our communication practices. By opting in to receive eNews, updates, and offers, you consent to receive email communications, including newsletters, administrative notices, and special offers. You can stop marketing emails at any time by updating your email preferences. Note that even with marketing preferences adjusted, you may still receive administrative emails regarding Service operations.

5. Managing Personal Information and Account Closure

5.a Reviewing Your Information

If your Personal Information changes, please notify us promptly. You have the right to access, update, and correct inaccuracies in your Personal Information, with certain exceptions. To do so, edit your profile in the My Account section. For security, we may request information to verify your identity before granting access. For details on reviewing children’s Personal Information, please refer to our Children’s Privacy Policy.

Legal or regulatory requirements may prevent us from providing access to some or all of your Personal Information. Information may also have been destroyed or anonymized per our data retention practices. If we cannot provide access, we will explain why, subject to legal restrictions. To stop information collection by a mobile application, uninstall the application using standard device processes.

5.b Account Closure

To close your account, please contact us. Teachers can remove student accounts by deleting students from their classroom roster. Parents should contact the school to request deletion of their child’s information. Schools can contact Learning A-Z for assistance. Upon account closure, we may delete your information without obligation, but we may retain data if necessary to prevent fraud, comply with law, or for legitimate business purposes like data analysis and enforcing our agreements. We disclaim liability for data deletion or retention as per this policy.

6. International Use of Services

Learning A-Z is based in the United States, and our data handling is governed by U.S. law. If you use our Services outside the U.S., you consent to data transfer to the United States. While our Services are accessible internationally, we do not guarantee compliance with the laws of other nations. If you are in a jurisdiction with internet usage laws differing from the U.S., you must use our Services lawfully within your jurisdiction.

7. Data Protection Measures

We employ reasonable technical, administrative, and physical security measures to protect your information from unauthorized access, ensure data security, and properly use collected information. These measures include encryption, access controls, and anti-virus/anti-malware software. Your account is password-protected, and we urge you to keep your username and password confidential. Teachers and parents are responsible for maintaining the confidentiality of their and their students’ login credentials. If you suspect a security breach, change your password immediately and notify us. Logout and close your browser after use.

In case of unauthorized access to student records subject to legal reporting, we will take prompt steps to mitigate impact, notify the affected educational customer without unreasonable delay, and assist them in any required notifications to parents or guardians. Despite our efforts, no security system is impenetrable. We cannot guarantee the security of transmitted information and are not responsible for data theft, loss, or inadvertent disclosure.

8. Links to External Websites

Our Services may contain links to other websites for user convenience. However, we are not responsible for the privacy practices or content of these external sites. This Privacy Policy applies only to information collected through our Services. When you navigate to a third-party website, our Privacy Policy is no longer in effect. We encourage you to review the privacy policies of any external websites before using them.
