This Privacy Policy is designed to clearly explain how Legends of Learning collects, utilizes, and protects information from you and the students who use our in-school online game-based learning and content platform (referred to as the “Platform”). It also applies to any of our websites, applications, and online services that link to this policy (collectively, along with the Platform, the “Services”). By accessing and using our Services, you are consenting to the practices regarding your information as described in this Privacy Policy.

Our user base includes:

  • Student Users: Children who engage with the gaming and educational aspects of our Services within a classroom setting.
  • Teacher Users: Educators who utilize our Services in the classroom to instruct Student Users and who also employ the administrative and reporting features of the Services.
  • Administrative Users: Non-teacher employees of Educational Institutions, such as principals and administrators.

Collectively, Teacher Users and Administrative Users are referred to as “School Users.”

Key Privacy Commitments from Legends of Learning

We strongly encourage you to read this entire Privacy Policy, along with the Legends of Learning Terms and Conditions, to fully understand our practices. For your convenience, we have highlighted some key points below:

  • Student Safe Guarantee: Legends of Learning provides a Student Safe environment. Students using our Platform in a school setting will never encounter any form of advertisements within the Platform.
  • Limited Student Data Collection: During Student User registration, we request minimal basic information, such as a Student User’s first and last name and/or initial, provided by a Teacher User or Administrative User, or by the Student User under their direction, to create a username.
  • Data Minimization: Our data collection and usage are strictly limited to the minimum information necessary for the operation of our Services and to enhance the educational experience.
  • Robust Data Security: The security of your personal information is paramount. We implement comprehensive physical, technical, and administrative security measures to protect all information collected by our Services. We also have a detailed Breach/Incident Response Plan in place to address any potential security incidents promptly and effectively.
  • User Data Control: School Users have the ability to review and manage Student User data. As detailed in the “How to Access, Change, or Delete Account Information” section of this Privacy Policy, School Users can contact us at any time to request access to, or deletion of, any personally identifiable information they have provided about Student Users associated with their account. They can also request to stop the collection of personally identifiable information from specific Student Users.

Website Visitors to Legends of Learning

When you visit our website, such as www.legendsoflearning.com, or any other site that references this Privacy Policy, we collect certain standard information, whether you are a registered user or not. This information includes data typically made available by web browsers and servers, such as your browser type, language preferences, referring website, and the date and time of your visit. We also collect Internet Protocol (IP) addresses and mobile device IDs. This standard data collection helps us to analyze website traffic, understand user behavior, and improve our website to better serve our visitors.

Legends of Learning User Accounts Explained

The way we collect, use, and disclose information is dependent on the type of Legends of Learning account and user involved. We operate with three primary types of accounts:

  1. Teacher Accounts: These accounts are directly established by Teacher Users via our website for classroom use.
  2. School Accounts: School Accounts are provided to Teacher Users through an Administrative User and are specifically for use by schools, school districts, or other licensed educational institutions or programs (“Educational Institutions”). School Accounts and Teacher Accounts are collectively referred to as an “Account.”
  3. Student Accounts: Student Accounts can only be created by a Teacher User or Administrative User in conjunction with a Teacher Account or School Account.
  4. Administrator Accounts: Administrator Accounts are exclusively created by Legends of Learning employees for Administrative Users.

For School Accounts, Student Accounts are typically populated in coordination with the Educational Institution’s data management policies. Login information for Student Users under School Accounts is provided in accordance with the Educational Institution’s protocols. For Teacher Accounts, Teacher Users create Student Accounts using names or nicknames assigned or generated in coordination with the Student User.

To enhance user experience and streamline access, Legends of Learning supports Single Sign-On (SSO) platforms, including Google, Classlink, Canvas, and Clever. Integrating with these third-party platforms may involve sharing information, which is governed by the respective third parties’ terms and privacy policies. School and Teacher Consent for Student Data

Legends of Learning Services are designed for use within educational settings and are not offered directly to students or parents. School Users are required to register for an Account before creating or inviting Student Users to establish Student Accounts. If we discover that a non-Student Account has been created by a student of any age, we will promptly delete that account.

By creating Student Accounts or providing playlist codes for Student Users to join and use the Services, School Users provide consent for the collection and use of Student User data as outlined in this Privacy Policy.

When School Users set up Accounts and invite Student Users, they act as representatives of the parents, granting Legends of Learning permission to collect information as described in this Privacy Policy. In these interactions, we function as a service provider to the School User.

Types of Data Collected by Legends of Learning

Information You Directly Provide to Us:

Legends of Learning and our third-party service providers collect information that School Users provide when they utilize our Services. This includes actions such as creating an account, contacting us with inquiries, participating in community message boards, and when Student Users engage in learning activities on the Platform.

To access the Platform, Student Users are asked to provide their first and last name or a nickname. Our commitment to data minimization ensures that we only collect and use the minimum data necessary to operate the Services effectively.

School Users may provide information in various scenarios:

  • Teacher Account Registration: When registering for a Teacher Account, users are required to provide their first and last name, email address, the subjects and grades they teach, school name, and the school’s physical address. Teacher Users also provide the first and last name (or nickname) of Student Users who will access the Services through their Teacher Account.

  • Service Purchases: For Teacher Users purchasing our Services, payment card information is required. This payment information is securely shared with our third-party payment processor, Stripe, and is not retained by Legends of Learning.

  • Optional Account Administration Information: School Users may optionally provide additional information through a password-protected section of the Services. This allows them to manage their accounts, including reviewing the Platform, providing testimonials, accessing customer support, and submitting comments or questions. Administrative Users may also use this section to add Teacher Users and Student Users, and review data related to Student Users and Teacher Users.

By providing information, you represent that you have the authority to do so, including any information pertaining to other individuals, for our use in accordance with this Privacy Policy. Furthermore, you affirm that you are authorized to consent to our collection of information from Student Users as per this privacy policy.

Information Collected Automatically:

Legends of Learning and our third-party service providers automatically gather information from users as they interact with the Services. For School Users, this may include data on usage patterns, duration of use, review and game play activity, credit and purchase history, and referral history. For Student Users, collected information includes usage patterns, activity start and completion times, performance on games and other Content, and the number of questions answered correctly or incorrectly. We may also record all or part of a Student User’s gameplay or activity sessions to analyze and improve the learning experience.

We employ various technologies, including cookies, to automatically collect technical information from your computer or mobile device over time and across different websites. This includes browser type, operating system, device type, pages viewed, IP address, mobile device ID, referring websites, and downloaded files. We utilize only strictly necessary cookies and functionality cookies, as defined by the International Chamber of Commerce (ICC) cookie guide. We use both session cookies, which expire upon closing your browser, and persistent cookies, which remain on your device for subsequent visits. Pixel tags, web beacons, and clear GIFs are also used to track website usage and email interactions, helping us understand user engagement.

Google Analytics helps us track and analyze website traffic and user behavior on our Application, generate reports on these activities, and share data with other Google services. GOOGLE TAG MANAGER (GOOGLE INC.)

Google Tag Manager is an analytics management service provided by Google Inc. This service allows us to manage website tags and scripts efficiently.

HUBSPOT

HubSpot is a marketing automation platform provided by HubSpot, Inc. It aids us in managing and analyzing our marketing efforts and user engagement.

How Legends of Learning Uses Collected Information

Legends of Learning and our third-party service providers use the collected information for the following purposes. It is important to note that information collected from Student Users is never used for marketing or advertising purposes. Information collected from School Users may be used for:

  • Marketing and Outreach: To provide School Users with relevant information about our products, send marketing communications, professional development and training materials, and newsletters that we believe may be of interest. This also includes measuring the effectiveness of our marketing efforts to reach potential users of our Services. We are committed to not sending any such marketing communications to Student Users. If you believe a Student User has received marketing communications, please contact us as described in the “Contact Us” section, and we will immediately cease such communications. School Users can manage their marketing communication preferences as detailed in the “Your Choices” section.

  • Service Delivery and Support: To enable user registration and access to our Services, process payments, provide customer and technical support, respond to inquiries, deliver training, and communicate about the Service, including updates on Student User progress and account information, as well as managing our community message boards.

  • Enhancing Educational Offerings: To facilitate participation in surveys, research studies, and other educationally relevant activities aimed at improving our educational content and user experience. Specific rules for these activities, including details on data usage, will be provided when applicable.

  • Improving Platform Functionality: To gain insights into how our Services are used, assess and enhance the Services, improve educational content, customize user experience, and personalize the learning journey. This includes recommending specific Content and playlists based on user performance and learning needs, and providing progress reports on Student User performance.

  • Legal Compliance and Protection: To comply with applicable laws, legal processes, and requests from government authorities; to enforce our terms and conditions; to protect our operations and the security of our Services; to safeguard our rights, privacy, safety, or property, and that of our affiliates, users, and others; and to pursue available legal remedies and limit potential damages.

Visibility of Student User Information

For School Accounts, Administrative Users designated by the Educational Institution have access to all Student User information within their School Account that is available through our Platform’s web-based user interface. This includes recordings of all games played and activities performed by Student Users. Administrative Users can delegate the right to view student information according to their Educational Institution’s policies. Teacher Users within a School Account can only access information related to Student Users in their own classes, unless granted additional access by an Administrative User. For School Accounts, sharing information with third parties is managed at the direction of the Educational Institution, ensuring compliance with their internal policies and legal requirements.

For Teacher Accounts, Teacher Users can access all information collected about Student Users interacting with the Services under their specific Teacher Account. However, Teacher Users cannot view information related to Student Users in other Teacher Users’ Accounts.

Sharing Your Information with Legends of Learning

Limited Information Display: Legends of Learning does not publicly display personally identifiable information about any user. You retain ownership of your personally identifiable information provided to us.

Advertising Practices: We permit third-party advertising networks to use tracking technologies, such as cookies and web beacons (as previously described), to collect information from users, excluding Student Users. These tracking technologies are not used in any area of the Platform used by Student Users or in the community message boards. These technologies enable third parties to deliver interest-based advertisements related solely to Legends of Learning products and services on other websites or social media platforms, and to provide us with statistics on the effectiveness of our advertising on third-party sites.

We do not disclose personally identifiable information of Student Users or School Users to third parties for their research, marketing, or promotional purposes.

Data Protection Commitment: Legends of Learning does not sell or rent user data to third parties under any circumstances. When information is shared with a third party, it is solely for our internal use and in conjunction with that third party to evaluate and improve the effectiveness of our Platform.

No Targeted Advertising to Students: There is absolutely no targeted or behavioral advertising displayed within the Legends of Learning Platform.

Information collected from users of the Services may be disclosed in the following ways:

  • Service Providers: We share information with third-party service providers who perform services on our behalf. These services include payment processing, analytics, research (such as educational efficacy studies), and marketing campaign management (excluding Student User targeting). These service providers are contractually obligated to maintain the confidentiality of the information and use it only for purposes permitted by this Privacy Policy. They are prohibited from sharing your information with other third parties. Our current third-party service providers include:

    • HubSpot: For marketing automation and analytics to improve communications with Teacher Users and Administrative Users.
    • Intercom: A chat platform for our Support Team to assist users of all ages with inquiries.
    • Appsignal: For application performance monitoring to analyze and improve website performance.
    • PostmarkApp: A marketing communications tool to enhance communications with Teacher Users and Administrative Users.
  • Legal and Compliance Disclosures: We may disclose information when we believe it is necessary or appropriate to comply with laws, legal processes, governmental requests, enforce our terms and conditions, protect our operations and security, and safeguard the rights, privacy, safety, or property of Legends of Learning, our affiliates, users, or others.

  • Business Transfers: In the event of a merger, acquisition, or sale of assets, Legends of Learning may transfer data to a third party, provided that the third party agrees to adhere to the terms of this Privacy Policy and Legends of Learning’s Information Security Practices.

  • De-Identified Data: We may share anonymized or de-identified data that does not identify individual users with third parties for various purposes, including research and service improvement. However, we strictly prohibit our third-party providers from selling, licensing, distributing, or disclosing this De-Identified Data.

  • Data Compilation: To enhance our services and interactions, we may combine user information with contact and social media information from publicly available sources or third-party data providers. For example, Stripe may obtain information from credit bureaus for identity verification.

Accessing, Modifying, or Deleting Your Account Information

School Users can review and modify their account information through the teacher or administrator dashboard. To request review or deletion of personally identifiable information related to Student Users associated with their Account, or to halt further collection of such information, School Users can contact us as described in the “Contact Us” section. Please note that deleting personally identifiable information may lead to the cancellation of your Account. Upon receiving a request to change or delete personally identifiable information, we will make diligent efforts to implement these changes in our active databases as quickly as reasonably possible. Changes to settings may not be immediate due to operational and maintenance schedules.

Account Cancellation, Reactivation, and Data Retention Policies

Teacher Users (excluding School Accounts) can cancel their Teacher Accounts at any time by emailing [email protected] or contacting us via the methods in the “Contact Us” section. Upon cancellation of a Teacher Account, all personally identifiable information associated with the account (“Account Information”) will be removed from our live databases within seventy-two (72) hours. Please be aware that canceling a Teacher Account will result in the loss of all activity and progress data for associated Student Users. If a Teacher Account remains inactive, we will remove all Account Information from active databases twenty-four (24) months after the last account activity. This 24-month period allows for account reactivation and potential recovery of Student User progress data, although we provide no guarantee of data recovery.

Cancellation, reactivation, and deletion of Account Information for School Accounts are governed by the terms of the agreement between Legends of Learning and the Educational Institution.

We retain personally identifiable information only as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements, after which it is deleted.

Even after account closure, please note that data deletion by third parties to whom information has been provided may not be immediate, and deleted information may persist in backup copies for a reasonable period, though it will not be actively accessible.

Following Teacher Account cancellation, Legends of Learning may continue to use de-identified Teacher and Student User information for internal support, research, administrative, and record-keeping purposes, including service marketing and improvement through research and analytics.

Your Choices Regarding Your Information

Email Communications: You can opt out of receiving promotional emails from us by clicking the “unsubscribe link” in those emails. We strive to process unsubscribe requests promptly. However, you cannot opt out of essential Service-related communications, such as updates to features, security notices, and technical alerts. For any questions about Service-related communications or unsubscribing, please contact us directly as detailed in the “Contact Us” section.

Cookies and Tracking Technologies: Persistent cookies can be removed through your web browser settings. Session cookies are temporary and are removed when you close your browser. You can configure your browser to refuse all cookies or to notify you when a cookie is being sent. Disabling cookies may affect the functionality of some website features. Disabling browser cookies will prevent web beacons from tracking specific activity, although they may still record anonymous visits from your IP address. Children’s Privacy at Legends of Learning

Legends of Learning is committed to protecting children’s privacy. Our website is not directed to children under 13, and we do not knowingly collect personal information from children under 13 without appropriate consent. Purchasing our Services requires you to be 18 years of age or older. Any collection of personally identifiable information from children under 13 within a school setting is conducted with school-provided permissions. If we become aware that we have collected personal information from a child under 13 without proper consent, we will take immediate steps to delete that information. Legends of Learning Services are controlled and operated exclusively from the United States and are intended for use primarily within the United States. Security Measures at Legends of Learning

The security of your personal information is a top priority for us. We implement robust physical, technical, and administrative security measures to protect the information collected by our Services. All data is encrypted in transit using TLS 1.2 and at rest. For example, all personally identifiable information is transmitted over HTTPS and stored securely by us or our third-party providers in secure server environments.
